How it Works
Legally Speaking, your landlord has to protect your deposit within 30 days of receiving it from you. This is primarily to prevent landlords using deposits as a form of income and also to ensure that the deposit is available at tenancy end. Landlords have three options to protect Deposits received from tenants: The Deposit Protection Service (DPS), The Tenancy Deposit Scheme (TSD) or MyDeposits.
If a Landlord is found to have failed to protect your deposit, they could become liable to a penalty of about 1 to 3 times the deposit amount received. Bear in mind that the total amount of a penalty will also be influenced by the number of breaches committed by the Landlord. This could become important in cases of renewals.
Further, if your landlord did not inform you where your deposit was registered within 30 days, or if they failed to protect your tenancy deposit within 30 days, you may be entitled to compensation.
